Guardianship and Conservatorship Committee
This committee’s work is related to Idaho Code section 31-3201G. Its duties include:
To make recommendations to the Court for improving reporting and monitoring systems and processes for the protection of persons and their assets where a guardian or conservator has been appointed in order to ensure safety, health, and well-being of the person under guardianship or conservatorship;
To make recommendations to the Court for developing and implementing innovative case management practices related to guardianship and conservatorship cases and civil commitment proceedings under Title 66, Chapters 3 and 4, Idaho Code, that promote efficient use of court services;
To make recommendations to the Court for developing and recommending best practices for judges and attorneys to consider alternatives to guardianship and, if guardianship is necessary, encourage guardianship under the least restrictive conditions consistent with the need for protection;
To make recommendations to the Court for identifying and addressing gaps and improvements to the court system to protect vulnerable individuals;
To make recommendations to the Court for considering program development, resource development, technical assistance and training opportunities for the development and sharing of best practices;
To provide bench cards or guides, develop forms, and establish or update protocols related to all aspects of guardianship and conservatorship proceedings and civil commitment proceedings under Idaho Code, Title 66, Chapters 3 and 4; and,
To identify processes and procedures to safeguard the rights of individuals placed under civil commitment pursuant to Idaho Code Title 66, Chapters 3 and 4.
